Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Chavi, operated by Ena Hotels LLC, a Maryland limited liability company (“we”, “us”, “our”). By creating an account or using Chavi you agree to these Terms.

1. Service description

Chavi is an operational dashboard for authorized business users. Subscription tiers and feature sets are described in your account.

2. Account

You must create an account to use most features of Chavi. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information.

3. Subscription and payment

Paid plans are billed monthly or annually as agreed during activation. Until self-service billing is live, cancellations and plan changes are handled through support and take effect at the end of the current billing period. We do not provide refunds for partial billing periods. We may modify pricing with at least 30 days' notice via email or dashboard.

4. SMS messaging program

By enabling SMS alerts in your Chavi account, you expressly consent to receive automated messages from Chavi to the mobile phone number you provide. Sign up via the public opt-in form at chavi.works/alerts.

• Program name: Chavi Alerts
• Message types: Operational rate-intelligence alerts about hotel performance, specifically: (1) competitive comp-set rate snapshots, (2) pricing rule violation alerts, (3) demand-signal notifications (event overlap, compression class, occupancy bands), and (4) housekeeping schedule recommendations.
• Message frequency: Variable based on your configuration; typically up to approximately 600 messages per month.
• Message and data rates may apply per your mobile carrier's terms.
• Reply HELP for help, or email support@chavi.works.
• Reply STOP to any message at any time to unsubscribe. After opt-out you will receive one confirmation message and no further alerts until you re-subscribe.

Consent to receive messages is not a condition of purchasing any Chavi subscription plan. You can use Chavi without enabling SMS alerts.

5. Acceptable use

You agree not to:

• Use Chavi to send messages to recipients without their consent.
• Transmit illegal, fraudulent, harassing, or infringing content.
• Attempt to access other users' accounts or data.
• Reverse engineer, decompile, or attempt to extract source code.
• Use Chavi to compete with or replicate our service.
• Resell or sublicense Chavi without written permission.

6. Data accuracy and disclaimer

Chavi is provided “as is” and “as available.” We make commercially reasonable efforts to ensure accuracy of data and insights, but cannot guarantee that data sourced from third-party systems is error-free. You are responsible for verifying critical business decisions before acting on Chavi recommendations.

7. Limitation of liability

To the maximum extent permitted by law, Ena Hotels LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of Chavi. Our total cumulative liability shall not exceed the amount you paid us for the service in the twelve (12) months preceding the claim.

8. Termination

You may terminate your account at any time by contacting support. We may suspend or terminate accounts for violation of these Terms, non-payment, or as required by law. Upon termination, your data remains available for export for 30 days, after which it is permanently deleted.

9. Modifications

We may update these Terms from time to time. Material changes will be communicated by email or dashboard notice with at least 30 days' notice. Continued use after notice constitutes acceptance.

10. Governing law and jurisdiction

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Harford County, Maryland.
